These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the Terms and Conditions set out below.

The Gibraltar Heritage Trust reserves the right to alter these Terms and Conditions from time to time without prior notification. The contract will be concluded in English.

The Website may only be used for lawful purposes. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

The Personal Information which you are required to provide when you register as a Customer should be true, accurate, current and complete in all respects; and you must;

Notify us immediately of any changes to the Personal Information by contacting our Main Office via e-mail, or calling us on +350 20042844 or by updating them in the account page information.

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

We reserve the right to:

• Modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.

• Change the Terms and Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed.

Product Descriptions

Each product purchased is sold subject to its Product Description. We have made every effort to reproduce colours on the Website as accurately as possible. However, different computers reproduce colours in slightly different ways, and so colour matches are not yet possible over the internet. If you are not satisfied with the colour of the item you have ordered, we offer a no quibble 30 day money back guarantee on all products. Please see our returns policy.
 

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system.

Making an Order

All communication to you from the Gibraltar Heritage Trust will be addressed to your email address as supplied when you register. If you do not receive a confirmation email after registering or placing an order please contact us immediately. The Gibraltar Heritage Trust will not be responsible if you should fail to receive emails sent to the email address you provide when you register.

The technical steps required, creating the contract between you and us are as follows:

• You place the order for your products on the Website by pressing the confirm button at the end of the checkout process.
• We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from the Gibraltar Heritage Trust.
• When your product is shipped from our warehouse we will send you a dispatch confirmation email.
• Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the products ordered unless we have notified you that we do not accept your order.

Non-acceptance of an order may be a result of one of the following:

• The product you ordered being unavailable from stock.
• The product you ordered being unavailable for delivery to your selected delivery country.
• Our inability to obtain authorisation for your payment.
• The identification of a pricing or product description error.
• You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

The Gibraltar Heritage Trust reserves the right to restrict the number of items available for sale to any individual Customer.

Orders are normally dispatched within 2 business days of the order date. The majority of orders are received within 7-14 business days. However, as we cannot guarantee the speed of the standard postal service please allow up to: 15 business days for Standard UK Delivery orders, and 20 business days for orders to the EU. These delivery periods are currently under review.

Payment

For your added security all payment pages are hosted and processed by WorldPay Ltd  which means that we don't hold records of your credit card details. Payment options at point of payment process include multiple currencies.

We accept all major credit cards as listed: Visa, Delta, Maestro, Switch, Visa Electron and MasterCard. We do not at present accept payment through PayPal.

We do not sell products to children, if you are under 18 you may use the Gibraltar Heritage Trust, but all orders must be made by your parent or guardian.

Cancellations

If you realise you have made a mistake when ordering, please try to contact us as soon as you can by email on heritage@gibraltar.gi (with the word “Cancel” present in the subject line), or in office hours by calling +350 20042844. We aim to dispatch items quickly and as such have limited time in which to stop completed orders from going out.
 

If your order has already left our warehouse and you decide to cancel, we will refund your order in full including any postage and packing you may have been charged up to a maximum of our Standard UK Delivery charge. Please ensure you inform us of your intent to cancel within 14 days of receiving your order. We will refund to the original payment method used to place the order and provide you with our returns address so you can return the goods to us at your expense. Please return the goods within 14 days. Please note, we reserve the right to await receipt of the returned goods, before issuing your refund.

Returns Policy

All products purchased through this website are covered by our 30 day no quibble guarantee. If you are not totally satisfied with your order or have simply changed your mind, please return the unopened product to us within 30 days of receiving your order and we will refund you. Please include a brief letter including your name and address and an explanation as to why you are returning the item(s). Please note we do not refund your postage unless the item is damaged, wrongly described or faulty.

For reasons of hygiene & safety, we cannot refund or exchange any grooming products or cosmetics that have been removed from the original wrapping (or show any signs of having been used) unless they are faulty.

VAT & Sales Taxes

We prepay VAT on all orders sent to a UK delivery address. If you live outside the UK and are charged sales tax, please send us a copy of the tax invoice by email to heritage@gibraltar.gi within 30 days and we will be happy to refund your money. We reserve the right, however, to change our tax refund policy at any time without notice.

Please note that in Gibraltar no sales tax or value added tax is levied, so all goods are sent free of taxes. On entry to your country you might be required to pay import taxes, this varies from country to country and changes from time to time.  Where Customs duties have been paid on imports into the European Union (EU) based on the customs value of the goods this incorrect charge will not be reimbursed.

Personal Information

We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable Gibraltar Data Protection and consumer legislation in place. Please see our Privacy Policy for more information.

Should you wish to close your account, please contact us at heritage@gibraltar.gi and we will be happy to organise this. Once you cancel your account you will no longer be able to shop online or receive e-mails from us. You can re-register at a later date using the same email address, however any historic order information will not be available to view.

You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting our team immediately.

The Trust is a non-profit making organisation registered as a Charity at the Supreme Court of Gibraltar and governed by the rules of the Charity Commissioner. Our charity registration number is 48.

Please note we are an online retailer selling direct to Customers and not a wholesaler. We do not sell large quantities of individual items. Consideration can be given to wholesale if you are a trader, or potential operating partner, who will purchase across the range i.e. small quantities of many products.
